Definitions
- Service: the cloud-based school management system made up of the OxKinder admin panel, teacher app and parent app.
- School Data: all data entered into the system by the School or by users on its behalf, including child, parent and staff records, attendance, daily care logs, medication records, images and payment records.
- User: any administrator, teacher, other staff member or parent granted access to the system by the School.
- Subscription Period: the term covered by the 1, 3, 6 or 10-month plan chosen by the School.
Scope of the service
The Service includes all ten modules: attendance, verified pickup, medication tracking, daily care log, meals and allergies, agenda, newsletters and gallery, fees and payment tracking, messaging, and app usage. There is no cut-down tier; the School can switch off the modules it does not use.
The finance module tracks payments; taking payments is not part of the Service as at the date of this agreement. In-app card payment is under development and will be announced separately when released; it may be subject to additional terms.
New features may be added and existing ones developed. Where a change would materially restrict the School's use, at least 30 days' notice is given.
Trial period
- The trial period is 15 days and is free of charge.
- No card details are requested for the trial.
- The account does not roll into a paid subscription by itself; moving to a subscription requires the School's express request.
- Branches, classes, staff and students entered during the trial are preserved when moving to a subscription.
Fees, payment and price changes
Charging is per student, per month, and the amounts published on the site include VAT. The longer the subscription period, the lower the per-student unit price; the current price table is published in the Pricing section.
On the 10-month plan, two further months of use are granted free of charge on top of the ten months paid for. Those two months are a gift and are not treated as paid months when a refund is calculated.
Prices are not changed during a running subscription period. A price change takes effect only at the start of a new period and is notified at least 30 days in advance. If the School does not accept the new price, it may choose not to renew at the end of the period.
Data protection roles
In practice this means: informing parents, obtaining parental consent for photographs and personal data, setting internal retention and access policies, and registering with VERBİS where required, are the School's obligations. OxKinder supplies the tools needed to meet them — consent records, retention periods, an audit trail and data export — and guides the School through them during setup; but it does not take the School's place.
As data processor, OxKinder undertakes to:
- Process School Data solely to provide the Service; never for its own purposes, never sold, never used for advertising
- Maintain separation between schools at database level, through row-level security policies
- Limit access to the staff the work requires, bound by confidentiality
- Notify the School without undue delay on becoming aware of a data breach
- Bind any sub-processor to the same obligations
Servers run on DigitalOcean in the Frankfurt (Germany) region, within the European Union; School Data is therefore processed outside Türkiye. The School should address this in the information it provides to parents.
The School's obligations
- It is responsible for the accuracy of the data it enters and for being legally entitled to process it.
- It is responsible for the security of user accounts, for passwords not being shared, and for revoking access when staff leave.
- It may not use the Service for unlawful purposes, in a way that disrupts the system, or by reverse engineering.
- It ensures parental consent has been obtained before sharing images of children.
Service continuity and support
24/7 technical support is provided; support channels and contact details are given to the School during setup.
Planned maintenance is carried out outside schools' working hours as far as possible and is announced in advance. Planned maintenance, outages originating from infrastructure providers and events of force majeure are not counted towards downtime.
Intellectual property
All rights in the OxKinder software, its interface, brand and visual identity belong to the service provider. A subscription grants the School the right to use the software for the subscription term, not ownership of it.
School Data belongs to the School. When a subscription ends, the School can export its data.
Termination and return of data
- The School may end its subscription at any time. Refund terms for prepaid plans are set out on the Cancellation and Refunds page.
- When a subscription ends, the School is given a reasonable period to export its data.
- At the end of that period School Data is deleted, except for records the law requires to be retained.
- If the School breaches this agreement and does not remedy the breach after notice, the service provider may terminate the subscription.
Force majeure
In circumstances outside the parties' control — natural disaster, epidemic, war, cyber attack, general failures of electricity or internet infrastructure, decisions of public authorities — failure to perform for as long as those circumstances last is not a breach of this agreement.
Governing law and disputes
This agreement is governed by Turkish law. The courts and enforcement offices of Bursa, Türkiye have jurisdiction over disputes between the parties. Where the buyer is a consumer, the jurisdiction rules of consumer legislation are reserved.
